Factual Summary report on the public consultation on the evaluation of the Public Procurement Directives

The public consultation on the evaluation of the Public Procurement Directives received 733 responses from a broad range of stakeholders, with public authorities, businesses and business associations being the most represented. While working on the comprehensive evaluation report, the Commission drew up a Factual Summary report covering the exploratory findings of the public consultation itself.  

This preliminary analysis showed that many respondents felt the Directives had not significantly improved procedural simplicity or flexibility. However, the digitalisation of procurement was broadly seen as helping to reduce administrative burdens – particularly for businesses. Transparency and equal treatment were generally viewed positively, but doubts were raised about the Directives’ effectiveness in fostering competition, market access and strategic goals such as green, social or innovative procurement. Views were mixed on whether the rules remain relevant, with concerns expressed over the reliance on price-only awards and limited competition. While the Directives’ internal coherence was largely acknowledged, many respondents felt they were not well aligned with more recent EU sectoral legislation.
